DuPont’s Development Regulations Challenged

FR/CAL 3 NW Landing Inc.(NW Landing) is the owner of approximately 260 acres in the Old Fort Lake area in DuPont. On May 24, 2018 NW Landing filed an appeal of the Mixed Use Village Land ordinance with the Growth Management Hearings Board. The ordinance is part of the Sub-Area Plan passed by the DuPont City Council to implement the new land use regulations for the Old Fort Lake properties.   

 

FR/CAL 3 NW Landing Inc. argues that the newly passed ordinance isn’t in compliance with the Growth Management Act and that there are too many restrictions regarding development rights. 

 

“The Planning Commission, City Council, and City Staff have put an enormous amount of time and effort into balancing protections for the community and opportunities for landowners. I’m proud of the ordinance that we passed and stand by it. We will respond and we expect to win” said Mayor Mike Courts. 

 

The City’s position is that it is in compliance with the Growth Management Act and will vigorously defend the appeal.
